This privacy notice aims to give you information on how Praesium Limited collects and processes your personal data with our website (www.praesium.com) and/or in providing consultancy services and how we keep it safe.

This website is not intended for children and we do not knowingly collect data relating to children.

2. The Data we collect about you

We process personal data about various categories of people, including our clients, people involved in matters we act on for our clients, people that we have relationships with and other third parties who interact with us (directly or through our websites).

Because of the nature of the services we provide, the types of data we process can be quite varied but may include:

Identity data:first name, last name and gender, identification (including copies of your passport)

Contact data: billing address, delivery address, email address and telephone numbers

Financial data: bank account or financial affairs

Transaction data: details about payments from you and details of services you have instructed us on

Technical data: internet protocol (IP) addresses, browser type and version.

Usage data: information about how you use our website and services

Marketing and communications data: your preferences in receiving marketing from us and your communication preferences.

 

In some circumstances we may process special categories of personal data in which case we’ll take care to only process data in accordance with strict legal parameters.  This can include racial or ethnic origin, religious or political beliefs, trade union membership, sex life or sexual orientation, genetic or biometric data or philosophical beliefs.

We also collect use and share aggregated data.  This may be derived from your personal data but isn’t considered personal data in law as this data does not indirectly or directly reveal your identity.  For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature.  We treat the combined data as personal data which will be used in accordance with this privacy notice.

If you fail to provide personal data

Where we need to collect personal data by law or under the terms of a contract, we have with you and you fail to provide that data when requested we may not be able to provide you with consultancy services.

How is your personal data collected?

We may get personal data from you directly, from our clients, from third parties involved in matters we act on for our client and from other third parties (including publicly available information).

Where you’re our client, it will sometimes be necessary for you to provide us with information directly and in those cases,  it’s your responsibility to make sure that all information is complete and not misleading.  The accuracy and appropriateness of our advice may be affected if you don’t do so.  If any information changes, please let us know so we can keep it updated.

How we use your personal data

We process personal data to provide consultancy services to our clients and for our own general business purposes including (but not limited to):

  • Fraud prevention, anti-money laundering,
  • Disclosures to our insurers and insurance brokers;
  • Managing business performance, assessing customer satisfaction, enhancing customer experience and improving our services;
  • Advertising, marketing and public relations and sending you direct marketing (if we’re permitted to do so).

We’ll only process your personal data where we have a lawful basis to do so.  Usually it will be one or more of the following:

  • the processing is necessary so we can perform the contract we are about to enter into or have entered into with you to provide legal services;
  • where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests – this includes the business of carrying out the business of providing consultancy services and pursuing our general business interests;
  • the processing is necessary for the establishment, exercise or defence of legal claims
  • where we need to comply with a legal or regulatory obligation.

In some circumstances we may process personal data on the basis that you’ve provided your express consent; for example, through instructing us on a matter (including where special categories of personal data are shared) and/or for direct marketing to you.  You have the right to withdraw consent at any time by contacting us.

Marketing from us

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what services you may need in the future. You’ll get marketing communications from us if you’ve requested information from us or we’ve provided you with services, and you have not opted out of receiving that marketing.

You can ask us to stop sending your marketing messages at any time by contacting us.

reCaptcha

We use Googles anti-spam software, reCaptcha to help combat spam emails. We have included links to Google’s Privacy Policy and Terms of Sevice so you can read more about how they collect and process data.

Change of purpose

We can only use your personal information for the purposes for which we collected it unless we reasonably consider that we need to use it for another purpose and that reason is compatible with the original purpose.  If you wish to get an explanation as to how the processing for a new purpose is compatible with the original purpose please contact us.

If we need to use your personal information for an unrelated purpose, we’ll tell you and will explain the legal basis that allows us to do so.

Please note that we may process your personal data without your knowledge or consent in compliance with the above rules when it is required or permitted by law.

3. Disclosures of your personal data

We may have to share your personal data with the parties set out below.

  • Internal third parties which may include secretarial support, postal support, service providers and IT service providers (such as cloud providers) and document storage facilities,
  • External third parties which may include other professional advisers, law firms, experts and or counsel
  • Third parties involved in any matter including (but not limited to) courts, tribunals, counterparties, experts, private investigators and any other third parties involved in a matter;
  • Debt collection and credit reference and tracing agencies
  • Government agencies, regulators and other authorities including the ICO and Ombudsmen
  • And our trade associations and professional bodies.

We require all third parties to respect the security of your personal data and treat it in accordance with the law.  We only permit them to process it for specified purposes and in accordance with our instructions. We would only share data with third parties after receiving your specific and informed consent.

4. International transfer of data.

We don’t transfer your personal data outside of the European Economic Area.

We’ll only pass information about you as an individual to third parties where you’ve consented.  If it’s outside of the EEA, some countries may not have laws that protect privacy rights as extensively as the EEA.  However, we’ll take proper steps to make sure that your information is properly protected.

5. Data Security

As required by UK data protection laws, we follow strict security procedures in the storage and disclosure of information which you have given us to prevent unauthorised access.

We use industry recognised storage to keep data secure, and prevent it from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.  We also limit access of your data to those who have a business need to know.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

6. Data Retention

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for including satisfying any legal, accounting or reporting requirements.

By law we must keep basic information about our customers including Contact, Identity, Financial and Transaction Data for six years after they cease to be clients for tax and regulatory reasons.

7. Your Legal Rights

Under certain circumstances you have rights under data protection laws in relation to your personal data.  You can find out information about your rights at www.ico.org.uk

You have rights to request from us access to, rectification of or erasure of your personal data.  If you want to exercise your rights then you can contact us at hello@praesium.com

We don’t usually charge a fee to access your personal data but we may charge a fee or refuse to comply if your request is clearly unfounded, repetitive or excessive.

We may need to request information from you to help us confirm your identity and make sure your right to access personal data.  This is a security measure to make sure personal data is not disclosed to any person who has no right to receive it.

We’ll try to respond to requests within one month.  If this isn’t possible then we’ll let you know.
